Acceptable Use Policy for PNS Agentic Services

 

This Acceptable Use Policy governs the use of agentic services (hereinafter “Agentic Service”) offered by Plan.Net Studios GmbH & Co. KG, Friedenstraße 24, 81671 Munich (hereinafter „PNS“) on the Agentic Service Marketplace (“Marketplace”) by the user (hereinafter „User“).

1 The User shall not use the Agentic Service for illegal purposes. In particular, the User may not use the Agentic Service

1.1       to defame (including but not limited to libel and slander), abuse, harass, stalk, threaten or otherwise violate the rights of others (including but not limited to their general right of privacy),

1.2       to process, publish, distribute, or disseminate obscene, adult-oriented, pornographic or unlawful material or information to harm minors in any way,

1.3       to generate code, files, scripts, agents or programs intended to do harm, including, for example, viruses, worms, time bombs and trojan horses,

1.4       to upload materials that contain software or other copyrighted, trademarked, patented, personally owned or otherwise legally protected material to the extent that the User does not have the necessary rights, licenses or consents,

1.5       to interfere with or disrupt the Agentic Service or the networks or servers connected to PNS,

1.6       to interfere with the use of the Agentic Service,

1.7       to promote unlawful activities,

1.8       to pursue unlawful purposes,

1.9       to promote content that has been indexed as harmful to young persons,

1.10    to use the Agentic Service to generate, promote or distribute disinformation,

1.11    to attempt to gain unauthorized access to the Agentic Service or its related systems or networks,

1.12    to permit direct or indirect access to or use of the Agentic Service in a way that circumvents a contractual usage limit, or use the Agentic Service to access, copy or use any of PNS’s intellectual property except as permitted under these Agentic Service Terms,

1.13    to frame or mirror any part of the Agentic Service, other than framing on the User's own intranets or otherwise for the User's own internal business purposes or as permitted by PNS, and/or

1.14    to use the Agentic Service in violation of applicable laws of a member state of the EU or any law applicable to the Agentic Service (“Applicable Laws”), including but not limited to, Applicable Laws regulating export control artificial intelligence.

2           The User must not use the Agentic Service for or in connection to any prohibited AI practice specified in the Artificial Intelligence Act (Regulation (EU) 2024/1689). In particular, the User may not

2.1       use subliminal, manipulative, or deceptive techniques that distort a person’s behavior so that they are unable to make informed decisions in a way that is likely to cause harm,

2.2       exploit any vulnerabilities related to age, disability, or socio-economic circumstances,

2.3       create or expand facial recognition databases without consent,

2.4       conduct real-time remote biometric identification in public spaces for law enforcement purposes,

2.5       evaluate or classify individuals based on their social behavior or personal traits (including social scoring or predictive profiling) leading to detrimental or unfavorable treatment,

2.6       assess or predict the risk of an individual committing a criminal offense based solely on their personal traits or on profiling,

2.7       infer an individual’s emotions in the workplace and educational settings, except when necessary for medical or safety reasons, and/or

2.8       categorize individuals based on their biometric data to deduce or infer sensitive attributes such as their race, political opinions, religious beliefs, or sexual orientation.

3           The User must not change the Agentic Service into a high-risk AI system within the meaning of the Artificial Intelligence Act (Regulation (EU) 2024/1689) or use it as such.

4           The User shall not decompile, disassemble or perform any other form of so-called reverse engineering of the Agentic Service or any other attempt to discover the source code or underlying components of the Agentic Service, algorithms, and the system of the Agentic Service, unless permitted by Applicable Laws. Section 69a para. 2 sentence 2 and Section 69d para. 3 German Copyright Act (UrhG) shall remain unaffected. In particular, the User is not entitled to rent, sell, lease, sublicense, assign, distribute, frame or mirror or otherwise transfer the Agentic Service or to make changes to the Agentic Service.
